Michigan Breastfeeding Laws...

Picture
When I began to write this article, I tried to find the laws that apply in my state, Michigan. To my complete surprise, there is only one law, which was passed in 1994. The law simply states that public nudity laws do not apply to a woman breastfeeding a child. That's it. That's the one and only law protecting breastfeeding women in Michigan. Because of lack of laws in Michigan, an owner or employee of any private place of business can ask you to leave their establishment if they do not want you to nurse there. Also, any person in a public place can ask you to leave if you are breastfeeding and it makes them uncomfortable. If you refuse to leave, the police can be called, and there is a possibility of you being escorted off of the property. There are laws on record that prohibit Alligators from being tied to fire hydrants, but nothing to protect a mother who is feeding her child.

To see a list of breastfeeding laws for your state, please visit the National Conference of State Legislatures website by clicking here.

If you decide to nurse in public, don't let the government get you down. If you are respectful of others around you, I seriously doubt that anyone would cause too big of a stink.

Break Time for Nursing Mothers

Fortunately for all nursing moms, there are laws protecting you in the workplace. President Obama passed the Patient Protection and Affordable Care Act, H.R. 3590, on March 23 and the Reconciliation Act of 2010, H.R. 4872, on March 30, 2010, which allows nursing mothers time and a place to express milk while at work. Employers in a business place of more than 50 employees must provide a place, other than a bathroom, as well as reasonable (unpaid) breaks to pump or feed their baby.

For an easy overview of the Break requirements, please visit the United States Department of Labor page Fact Sheet #73.
